1. Overview

These Terms & Conditions govern your use of the Deluge Beautee LLC website and booking platform (delugebeautee.com), including our AI Nail Advisor tool, booking system, Deluge Collective features, Deluge Spaces, and all related services. By using this website, booking a service, or joining as an independent Artist on this platform, you agree to these terms in full.

Deluge Beautee LLC (β€œDeluge Beautee,” β€œwe,” β€œus,” or β€œour”) operates as a beauty service platform. We connect clients with independent licensed beauty professionals (β€œArtists”) and provide the technology, booking infrastructure, and brand framework that enables those connections. Deluge Collective and Deluge Spaces are sub-platforms operated under Deluge Beautee.

2. Platform Nature β€” Independent Contractor Relationship

Deluge Beautee is a platform, not a staffing agency or salon employer.

  • Each Artist operating through Deluge Beautee is an independent contractor, not an employee, agent, or representative of Deluge Beautee LLC
  • Deluge Beautee does not control the day-to-day methods, tools, techniques, or scheduling of any individual Artist
  • Deluge Beautee does not guarantee, warrant, or accept liability for the quality, safety, legality, or outcome of services performed by any independent Artist on the platform
  • Clients who have complaints or disputes regarding services rendered by an Artist must contact that Artist directly in the first instance
  • Deluge Beautee may, at its sole discretion, assist in dispute resolution but is not obligated to do so and is not a party to the service agreement between client and Artist

3. Artist Onboarding Requirements

All Artists joining the Deluge Beautee platform must meet the following requirements prior to activation:

  • Hold a valid, current cosmetology, nail technician, esthetics, or applicable professional license as required by the State of Missouri or applicable jurisdiction
  • Submit to and pass Deluge Beautee's internal application and approval process
  • Agree to these Terms & Conditions in full, including all Artist-specific provisions herein
  • Carry their own professional liability insurance and provide proof upon request
  • Maintain a professional standard of conduct consistent with Deluge Beautee's brand guidelines

Deluge Beautee reserves the right to deny, suspend, or terminate any Artist's access to the platform at any time, for any reason, including but not limited to violation of these Terms, client complaints, license lapse, or conduct inconsistent with platform standards. Platform administrators designated by Deluge Beautee LLC are responsible for artist approval and platform oversight.

4. Artist Roles & Responsibilities

When operating under the Deluge Beautee platform, each Artist agrees to:

  • Perform all services using their own professional judgment, tools, and techniques
  • Set their own pricing, availability, and service menu within the platform
  • Honor all bookings made through the platform in a professional and timely manner
  • Communicate directly with clients regarding service details, aftercare, and any issues
  • Process client payments through approved platform payment methods
  • Comply with all applicable Missouri state laws and professional licensing requirements
  • Not represent themselves as employees of Deluge Beautee LLC
  • Maintain their own professional liability insurance

5. Platform Fee Structure β€” Deluge Collective vs. Deluge Spaces

Deluge Beautee operates two distinct fee structures depending on the service context. It is important to understand which applies to you:

Deluge Collective β€” Artist Booking Commission

A Deluge Beautee platform. Applies when a client books an Artist through the Deluge Beautee platform for a direct service (mobile, in-home, or at the Artist's own location).

  • Artists pay whichever is less β€” 15% of monthly booking revenue OR the monthly cap
  • Solo artists: $35/month cap
  • 2 members: $60/month. 3 members: $80/month. 4 members: $99/month. 5+: $120/month
  • No monthly subscription. Join free. Pay only when you earn.
  • The deposit a client pays to secure a booking is a prepayment toward the total service cost β€” it is not the basis for calculating commission

Deluge Spaces β€” Station Rental Platform Fee

A Deluge Beautee platform. Applies when an Artist books a workstation at a salon through Deluge Spaces. This is a separate fee from the Deluge Collective commission above.

  • Artist platform fee: 3% of service price per booking
  • Salon Host platform fee: 3% of their rental earnings per booking
  • Artist also pays a supply tier rental rate to the Salon Host (10%–27% depending on tier)
  • These fees cover platform infrastructure, booking management, and payment processing

These are two separate fee structures that serve different platform functions. The Deluge Collective commission applies to standard artist bookings through the Deluge Beautee platform. The Deluge Spaces platform fee applies to station rentals through Deluge Spaces. An Artist using both services may be subject to both fee types on different transactions.

For Clients: There are no additional platform booking fees charged to clients. The price shown at booking is the price paid (plus applicable tips at your discretion).

Artist Platform Agreement

The following subsections (5A–5E) apply specifically to Artists operating on the Deluge Beautee platform.

Section 5A β€” Commission & Fee Structure

No monthly subscription. Join free. Pay only when you earn.

Artists pay whichever is less β€” 15% of monthly booking revenue OR the monthly cap. The commission is always calculated from the full booking value, not from the deposit amount. Monthly caps by group size:

  • Solo artist: $35/month cap
  • 2 members: $60/month
  • 3 members: $80/month
  • 4 members: $99/month
  • 5+ members: $120/month

No Artist or group will ever pay more than their applicable cap in a single calendar month, regardless of booking volume. The commission is calculated from the total service price and deducted from client payments processed through the platform. The client deposit is a prepayment that secures the booking β€” it does not determine the commission amount.

Section 5B β€” Payment Schedule

Artist earnings (total service price minus applicable platform fee) are transferred weekly every Friday via the Artist's registered payment method. Deluge Beautee reserves the right to adjust payout timing with 7 days notice.

Section 5C β€” Non-Circumvention (Deluge Spaces)

If an Artist and a Salon Owner are connected through Deluge Spaces, any ongoing working arrangement between them that originates within 6 months of their first Deluge Spaces booking must continue to be processed through the Deluge Beautee platform for a period of 6 months from the date of first connection. After this 6-month period, both parties are free to arrange work independently. Violation of this clause may result in suspension or termination of platform access.

Section 5D β€” Artist Safety & Check-In

For the safety of both Artists and Clients, Artists are encouraged to use the platform's voluntary check-in feature when arriving at a booked location. Check-in is voluntary and does not constitute monitoring or control of the Artist's work. Deluge Beautee is not liable for any incidents that occur at service locations, whether or not the Artist has checked in.

Section 5E β€” Artist Conduct & Platform Standards

Artists agree to:

  • Maintain a professional appearance and conduct at all times while representing Deluge Beautee
  • Respond to client inquiries within 24 hours
  • Honor all confirmed bookings β€” cancellations under 4 hours are recorded and may affect platform standing
  • Not misrepresent their services, pricing, or qualifications on the platform
  • Not solicit clients booked through Deluge Beautee to pay outside the platform

Deluge Spaces β€” Salon Host Agreement

The following subsections (6–6G) apply specifically to Salon Hosts listing spaces on the Deluge Spaces platform.

Section 6 β€” Deluge Spaces Overview

Deluge Spaces is a Deluge Beautee platform that allows licensed salon owners (β€œHosts”) to list available workstations for use by independent beauty professionals (β€œArtists”). By listing a space on Deluge Spaces, Hosts agree to the following terms.

Section 6A β€” Listing Requirements

When listing a space on Deluge Spaces, Hosts agree to:

  • Upload photos of the workstation or working area only β€” no salon name, logo, signage, or identifying branding may appear in listing photos
  • Provide only a zip code or general area for the listing location β€” full address is revealed only after a booking is confirmed
  • Accurately describe the station type and what supplies are included
  • Keep listing information current and accurate at all times

Section 6B β€” Station Types & Rates

Artists booking through Deluge Spaces pay the salon host a rental rate based on the station type and what the salon provides:

Hosts set the quantity available for each station type when listing. Artists pay both the salon rental rate and the 3% Deluge Beautee platform fee per booking. All fees are deducted automatically.

Section 6C β€” Platform Fee

Deluge Beautee charges both parties a platform fee of 3% per confirmed booking:

  • Artist pays: 3% of service price to Deluge Beautee
  • Salon Host pays: 3% of their rental earnings to Deluge Beautee

These fees are deducted automatically and cover platform infrastructure, booking management, payment processing, and quality standards enforcement.

Section 6D β€” Non-Circumvention

If a Salon Host and an Artist are connected through Deluge Spaces, any ongoing working arrangement originating within 6 months of their first booking must continue to be processed through the Deluge Beautee platform for 6 months from the date of first connection. After this period, both parties are free to arrange work independently. Violation may result in removal from the platform.

Section 6E β€” House Rules & Conduct

All Artists booking through Deluge Spaces agree to the following default house rules, which Hosts may supplement with their own additional rules in their listing:

  • All Artists must hold a valid professional license for services offered
  • Artists may arrive no more than 30 minutes before their booking for setup
  • Artists must vacate promptly after their last client β€” Hosts set their own cutoff time in their listing
  • Workstations must be cleaned completely after every client
  • No unauthorized guests inside the salon
  • Client contact information is private β€” never shared with salon staff
  • All payments processed through the platform β€” no cash exchanges between Artist and Host
  • Artists are responsible for any damage to equipment or property
  • All applicable state health and sanitation standards must be followed
  • Violations are tracked and may affect platform standing

Section 6F β€” Cancellation Policy (Deluge Spaces)

  • Client cancellations: automatically notified to both Artist and Host β€” Host may immediately relist the spot
  • Artist cancellations with 4+ hours notice: no penalty, Host notified immediately
  • Artist cancellations under 4 hours: 1st time recorded, 2nd time warning, 3rd time credit score deducted, 4th time 3-day suspension
  • Artist no-show: 1st time warning, 2nd time 3-day suspension, 3rd time 1-week suspension, 4th time case reviewed

Violations reset after 3 months of no incidents.

Section 6G β€” Host Responsibilities

Hosts are responsible for:

  • Maintaining a clean, safe, and professional working environment
  • Ensuring all equipment is in good working order
  • Providing accurate supply tier information
  • Not interfering with the Artist's client relationship or contact information
  • Carrying appropriate property and liability insurance for their salon space

Reporting & Accountability

If a Salon Host misrepresents their supply tier or fails to provide the supplies listed in their listing, the Artist has the right to report the discrepancy through the Deluge Beautee platform.

Upon a verified report, the Artist has two options:

  • Option 1 β€” Adjust & continue: The Artist may choose to continue the session and pay only the rental rate that matches what was actually provided β€” not the listed tier rate. Deluge Beautee will adjust the booking charge accordingly based on the Artist's report.
  • Option 2 β€” Cancel & leave: The Artist may cancel the booking without penalty. Their spot fee will be refunded in full.

In both cases, the incident is recorded against the Host's account:

  • First offense: written warning
  • Second offense: listing suspended pending review
  • Third offense: permanent removal from Deluge Spaces

Deluge Beautee reserves the right to conduct spot checks and verify listing accuracy at any time. Hosts found to have deliberately misrepresented their listing will be removed immediately regardless of offense count.

7. Tax Reporting β€” Form 1099

Each Artist operating on the Deluge Beautee platform is an independent contractor for tax purposes. Deluge Beautee LLC will:

  • Issue a Form 1099-NEC to each Artist who receives $600 or more in platform-facilitated payments during a calendar year, in accordance with IRS requirements
  • Generate and distribute 1099 forms by January 31 following the close of each tax year
  • Maintain records of all transactions processed through the platform for tax reporting purposes

Artists are solely responsible for reporting their income, paying applicable self-employment taxes, and complying with all federal, state, and local tax obligations. Deluge Beautee does not withhold taxes on behalf of Artists. Artists should consult a qualified tax professional regarding their individual tax obligations.

8. Satisfaction Guarantee β€” All Artists

All Artists on the Deluge Beautee platform are required to uphold a minimum satisfaction guarantee standard. Each Artist must:

  • Stand behind the quality of their work
  • Address client concerns promptly and professionally
  • Offer a corrective service or resolution for documented quality issues reported within 7 days of the appointment
  • Respond to client concerns within 48 hours of contact

What is covered (minimum standard for all Artists):

  • Lifting, peeling, or premature breakage not caused by client mishandling
  • Uneven application, shape inconsistencies, or finish defects
  • Service outcomes that do not match what was agreed upon at the time of booking
  • Lash extensions that fall out abnormally beyond normal natural shedding (where applicable)

What is not required to be covered:

  • Damage caused by improper aftercare
  • Normal wear and natural separation after 7 days
  • Client change of mind on style, color, or shape after the service is complete
  • Services performed on nails or skin flagged as potentially problematic at the time of booking

Individual Artists may offer guarantees that exceed this minimum standard at their own discretion. Clients should review each Artist's individual policy at the time of booking.

9. Booking, Deposits & Cancellation Policy

Deposits

All appointments require a non-refundable deposit to secure your booking. The deposit is a prepayment toward the total service cost and does not affect how the platform commission is calculated.

  • Collectives may configure a minimum deposit percentage β€” available options are 20%, 30%, 40%, or 50% of the total service price
  • The minimum deposit amount is $30 β€” if the calculated deposit is below $30, the deposit will be $30
  • Deposits are applied toward your total service cost

Deposit Examples

  • $200 service at 40% deposit = $80 deposit (40% of $200)
  • $50 service at 40% deposit = $30 deposit ($20 calculated, but $30 minimum applies)

How the Platform Fee Works with Deposits

The Deluge Beautee platform fee (15%) is always calculated from the total service price, not the deposit amount.

  • Service total = $200, Deposit = $80 (40%)
  • DB platform fee = $30 (15% of $200 total service price)
  • Artist earnings = $170 (85% of $200 total service price)

Cancellation Windows

Collectives may configure a cancellation confirmation window. Available options:

  • 2 hours before appointment
  • 12 hours before appointment
  • 24 hours before appointment
  • 48 hours before appointment

Cancellation & No-Show Payout

If a client cancels inside the configured cancellation window or does not show:

  • The client forfeits their deposit
  • Deluge Beautee retains 15% of the total service price from the forfeited deposit
  • The remaining forfeited deposit is paid out to the Artist / Collective

Cancellation Payout Example

  • Service total = $200, Deposit paid = $80
  • Client cancels inside cancellation window
  • DB platform fee = $30 (15% of $200 total service price)
  • Artist payout from forfeited deposit = $50 ($80 deposit βˆ’ $30 DB fee)

No-Show Policy

  • If you have not arrived within 15 minutes of your scheduled appointment time, your appointment will be automatically cancelled and your deposit will be forfeited
  • You will receive an SMS notification confirming the cancellation

Rescheduling

  • To reschedule, contact your Artist before the configured cancellation window
  • With sufficient notice, your deposit is saved and applied to your next booking
  • Inside the cancellation window, your deposit is forfeited per the cancellation policy above

10. Dispute Resolution Between Clients and Artists

  1. Step 1 β€” Direct Resolution: Contact your Artist directly within 7 days of your appointment
  2. Step 2 β€” Platform Escalation: If unresolved within 5 business days, either party may escalate to Deluge Beautee at (314) 594-4494 or @delugebeautee on Instagram
  3. Step 3 β€” Platform Review: Deluge Beautee will review in good faith and may facilitate communication, issue a platform credit, or take action regarding the Artist's platform standing
  4. Limitation: Deluge Beautee's financial liability in any client-Artist dispute is limited to the platform commission collected on that booking. Deluge Beautee is not responsible for refunding service amounts paid directly to Artists.

11. Press-On Nail Orders

  • Custom press-on nail sets are made to order and are non-refundable once production has begun
  • Contact us within 48 hours of delivery if your order arrives damaged or incorrect
  • We are not responsible for damage from improper application or removal

12. SMS Messaging Terms

By opting in, you agree:

  • Message and data rates may apply
  • Message frequency varies based on your appointment and order activity
  • Reply STOP at any time to unsubscribe
  • Reply HELP for assistance, or contact (314) 594-4494

13. AI Nail Advisor Tool

By using the Nail Advisor tool, you acknowledge:

  • Recommendations are for inspiration and reference only β€” not a professional guarantee of any specific outcome
  • Actual results may vary based on your natural nail condition, skin tone, and products used
  • Photos you upload are voluntarily submitted
  • Uploaded photos may be retained as design reference and general inspiration β€” not used in public marketing without your explicit separate consent
  • We reserve the right to modify, discontinue, or update the tool at any time

14. Intellectual Property & Copyright

All content on this website β€” including the AI Nail Advisor tool concept and design, website design, text, graphics, nail photos, and branding β€” is the original creative work of Deluge Beautee LLC and is protected under applicable U.S. copyright law.

16. Limitation of Liability

Deluge Beautee LLC is not liable for any indirect, incidental, or consequential damages arising from your use of our website, AI Nail Advisor tool, platform, or any services performed by independent Artists. Our total liability in any matter is limited to the amount of platform commission collected on the specific transaction in question.

Deluge Beautee expressly disclaims liability for:

  • Services, outcomes, or conduct of independent Artists
  • Disputes between clients and Artists
  • Any injury, allergic reaction, or adverse outcome from services performed by Artists
  • Artist income loss due to platform downtime or technical issues

17. Changes to These Terms

We may update these Terms at any time. Continued use of our website or platform after changes are posted constitutes acceptance of the updated terms. Artists will be notified of material changes via their registered contact information with at least 30 days advance notice.

18. Governing Law

These terms are governed by the laws of the State of Missouri, United States.

19. Insurance Requirement

All artists on the Deluge Beautee platform are required to maintain active liability insurance with minimum coverage of $1,000,000 per occurrence. Proof of insurance must be uploaded during signup and kept current. Profiles will be suspended if insurance lapses.
